Mexico’s Supreme Court Rules That E-cigarette Ban Is Unconstitutional

On November 6, the First Chamber of the National Supreme Court of Mexico (SCJN) ruled that the ban on the import of e-cigarettes and related products is unconstitutional, based on the decree of the General Import and Export Tax Law promulgated on June 7, 2022 and approved by a majority vote.

The Supreme Court ruled that while Philip Morris was allowed to import vaping devices, it did not allow unlimited consumption of vaping liquids associated with vaping devices. The ruling does not mean that the use of e-cigarettes is completely open, but is limited to Philip Morris and does not affect other similar products that may appear on the market.

According to the Mexican government, an estimated 938 thousand teenagers have tried e-cigarettes, and about 160 thousand teenagers regularly use them. Despite the ban, the number of e-cigarette users in Mexico has increased significantly. The number of e-cigarette users in the country is reported to be 2.1 million in 2023, up from 975 thousand in 2019.
