The US FDA recently issued a number of vape warning letters

  * Smoking is harmful to health, minors are prohibited from using e-cigarettes, non-smokers are not recommended to use e-cigarettes*

On October 30, 2024, the FDA issued warning letters to nine online retailers and one manufacturer, accusing them of selling and / or distributing unauthorized disposable e-cigarettes that are designed and function similar to electronic products such as mobile phones and gaming devices.
The products mentioned in the warning letter are believed to have multiple designs and features that may appeal to young people, such as the ability to play games, connect to smartphones, receive text or phone notifications, play music or use personalized features such as custom wallpapers.

“These products may look like smart devices, but they are not smart at all,” said Dr. Brian King, director of the FDA’s Center for Tobacco Products. “Selling them is illegal and a blatant attempt to target children.”   
The design of these unauthorized products may appeal to young people because it helps hide the fact that the products are tobacco products from parents, teachers, or other adults. In addition to the violations mentioned in the warning letter, retailers and manufacturers are warned to address all other violations identical to or similar to those described in the warning letter and to promptly take the necessary steps to comply with the law. Failure to correct the violation in a timely manner may result in other actions by FDA, such as injunctions, seizures, and / or civil fines.  
The FDA has issued more than 700 warning letters to companies that manufacture, sell and / or distribute unauthorized new tobacco products. More than 690 warning letters were issued to retailers selling unauthorized tobacco products, and civil penalty complaints were filed against more than 75 manufacturers and more than 150 retailers.
